Development of an Appendix to the Entrustment Act for Service of General Economic Interest for the calculation of compensations pursuant to Decision 2012/21/EC on the application of Article 106 (2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest for project: Construction and operation of a CHP plant as part of municipal waste management system of Sofia Municipality for utilization of Refuse Derived Fuel (RDF) produced by municipal waste for combined energy production (2016-2018)
In connection with the implementation of Phase III of the Integrated Waste Management Project in Sofia, Infraproject Consult Ltd provided services for the development of an Appendix to the Entrustment Act for Service of General Economic Interest for the calculation of compensations pursuant to Decision 2012/21/EC on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of compensation for the provision of a public service of general economic interest granted to Toplofikatsia Sofia EAD entrusted with the operation and development of the project Construction of a CHP with RDF utilization in Sofia.
The total cost of the RDF CHP project amounts to EUR 157.5 million.
The range of services provided by the company included:
- Stage І: Development of a model for the ex-ante calculation of the amount of compensation pursuant to Article 5 (2) of the Decision 2012/21/EC, a mechanism for the control and check of absence of overcompensation or cross-subsidization and a claw-back mechanism.
- Stage ІІ: Preparation and submission of final calculations of compensation in compliance with Decision 2012/21/ЕС and substantiation of the calculations considering the comments of the Client and JASPERS, including compatibility check in compliance with Article 2 of the Decision 2012/21/EC, overcompensation Check in compliance with Article 5 of the Decision 2012/21/EC, development of a mechanism for ex-post monitoring of the overcompensation and development of a claw-back mechanism.
- Stage ІІІ: Answers to the questions and comments of the European Commission and revision of the documents in view of the comments.
Activities under the project also included participation in working meetings with the EIB, MoEW and other stakeholders of the project as well as participation in public consultations.
